Home Fraud Defense, LLC ("HFD") respects intellectual-property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

How to Submit a Takedown Notice

To be effective under the DMCA, your written notice must include:

  1. A physical or electronic signature of the copyright owner or someone authorized to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or, for multiple works at one site, a representative list).
  3. Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it (URL preferred).
  4. Your contact information (full name, mailing address, telephone number, and email address).
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Counter-Notice

If material you posted was removed in response to a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a counter-notice that includes:

  1. Your physical or electronic signature.
  2. Identification of the material removed and the location at which it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed by mistake or misidentification.
  4. Your full name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court in the district where you reside (or, if outside the U.S., to the U.S. District Court for the District of Arizona) and will accept service of process from the original notice sender.

Repeat-Infringer Policy

We will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.

Misrepresentation

Under section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees.

HFD has designated the agent listed above with the U.S. Copyright Office in accordance with 17 U.S.C. § 512(c)(2). The Copyright Office's online directory of designated agents is available at https://dmca.copyright.gov/osp/.
