Bain v. Platinum Realty, LLC

A buyer followed fraudulent wiring instructions that appeared to come from a real estate agent's email account. The agent represented the sellers, not the buyer. A federal jury found the agent and brokerage liable on a negligent-misrepresentation theory and assigned them 85% of the fault, on total damages of $196,622.67.

Commercial escrow

Mago v. Arizona Escrow & Financial Corp.

In a commercial escrow transaction involving the purchase of a franchise, an imposter used a lookalike email address to send fraudulent wiring instructions. The escrow company released approximately $79,000 without telephone confirmation. The jury assigned the escrow company 100% of the fault and assigned none to the imposter or to the party whose email was compromised.

A pilot establishes baseline data and evaluates enrollment, training completion, notice delivery, alert engagement, incident-reporting activity, brokerage participation, and available claim and loss trends over an agreed period.

Any conclusion about claim impact should rest on sufficient carrier data, appropriate actuarial analysis, and an agreed evaluation period.

I helped law enforcement during an active real estate fraud investigation involving a senior homeowner. It exposed a clear gap: the schemes had become more sophisticated, and the recurring fraud-awareness infrastructure for real estate professionals had not kept pace.

As a pilot, I retrained every single year for emergencies with odds close to one in a million. In real estate, fraud now reaches nearly one in four homebuyers during a closing, and most licensees train for it once, if ever. Why would we train less for the thing that is actually happening?
