Terms of Service

1. Agreement to Terms

By accessing or using HFD Fraud Scan (the "Service"), operated by Home Fraud Defense™ ("HFD," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service.

2. Description of Service

HFD Fraud Scan is an AI-powered real estate fraud detection tool. Users may submit suspicious messages, emails, or screenshots for analysis. The Service also includes the Property Fraud Registry, a professional database for searching and reporting property fraud activity. HFD operates these services to support real estate professionals, buyers, and sellers nationwide.

3. Educational Purpose — Not Legal Advice

The Service is provided for educational and informational purposes only. Analysis results, fraud scores, verdicts, and any other output from HFD Fraud Scan do not constitute legal advice, and should not be relied upon as a substitute for consultation with a qualified attorney, law enforcement, or other professional advisor. Home Fraud Defense™ makes no warranty as to the accuracy, completeness, or reliability of any analysis.

4. Open Tools and Pro Accounts

The free fraud-scanning tools on this site are open and require no consumer account. You may use them without registering. Anonymous use is subject to fair-use rate limits and the data-handling rules in our Privacy Policy (24-hour automatic deletion of scanner inputs).

An account is required only for Pro features — the Property Fraud Registry, the HFDCP™ professional certification program, and paid monitoring services such as deed alerts. If you create a Pro account, you agree to provide accurate, current, and complete information and to keep your credentials secure. You are responsible for all activity under your account. HFD reserves the right to suspend or terminate accounts that violate these Terms.

5. Subscription & Billing

The HFDCP™ Designation is $399 for the initial certification and $199 per year for ongoing credential maintenance, tool access, intelligence updates, and priority access to future programs. All amounts are billed through Stripe and exclusive of any applicable taxes. Subscriptions renew automatically until cancelled. You may cancel at any time through your account portal or by emailing info@homefrauddefense.org with the subject line "Cancellation Request". Sponsor plans are billed separately pursuant to the applicable sponsorship agreement. HFD may change pricing on 30 days' advance written notice to existing subscribers.

60-day refund. If you cancel your HFDCP™ subscription within 60 calendar days of the initial certification charge or any renewal charge, HFD will refund the full amount paid for that charge. Refund requests after the 60-day window are not provided, except where required by applicable law. To request a refund, email info@homefrauddefense.org with the subject line "Refund Request" and the email address on your account.

6. Acceptable Use

You agree not to:

• Submit content that is false, misleading, defamatory, or violates any third party's rights
• Use the Service to harass, intimidate, or harm any individual or business
• Attempt to reverse-engineer, scrape, or extract data from the Service in bulk
• Use automated bots or scripts to access the Service without prior written consent
• Submit fraudulent or fabricated registry reports
• Violate any applicable federal, state, or local laws in connection with your use of the Service

7. Content You Submit

By submitting content to the Service, you grant Home Fraud Defense™ a limited, non-exclusive, royalty-free license to process and analyze that content for the sole purpose of generating your fraud-analysis result and operating the Service. You represent and warrant that you have the right to submit such content and that it does not violate any law or third-party rights.

Scanner-tool submissions are not retained for training. Phone, email, URL, message-review, and address scans you submit through the open tools are processed in-memory and automatically purged from our active database within 24 hours. We do not train AI models on user submissions. Fraud-registry submissions and Pro-saved records are governed by the longer retention periods set out in our Privacy Policy and Retention Policy.

8. Intellectual Property

HFD Fraud Scan, Home Fraud Defense™, and all associated logos, trademarks, software, and content are the exclusive property of Home Fraud Defense™ or its licensors. Nothing in these Terms grants you any right to use HFD's trademarks, trade names, or other intellectual property without our prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HFD DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOME FRAUD DEFENSE™ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO HFD IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Home Fraud Defense™ and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Home Fraud Defense™ is principally located, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the applicable state or federal courts.

13. Changes to Terms

HFD reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date above and, where appropriate, notifying registered users by email. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
